The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the announcement of a new 28-point plan for resolving the conflict appeared – temporarily – to have been contained. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Peace Talks and Military Action

The chain of contrasting events captured the grim essence of the outgoing year. By day, diplomatic battles are fought: optimistic declarations are issued from various governments. Immense energy is allocated on containing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "settlement".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was revealed. Ukraine is capable of detecting projectile deployments from Russian territory, a capability enabled by timely intelligence. From vantage locations, military aircraft that had been deployed to engage hostile guided weapons roared overhead – modern combat jets supplied to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems activated: multiple launches targeted at a incoming threat. This was a sophisticated defense system at work, most likely supplied through partner states. Every firing creates sudden vibrations, shaking the windows. The moment of terror quickly transforms into resigned acknowledgment: perhaps the incoming missile won't strike its target this time, sparing the city from ruin and another blackout.

Ongoing Risks

Soon after, a automatic firearm fired at a unmanned aircraft somewhere nearby, part of a mobile-fire group – almost certainly imported technology. Sadly, the bullets missed the hostile drone – it pressed on overhead toward its target.

Intermittently, this carried on until dawn. Kyiv greeted the early updates: multiple fatalities, damage and utility failures in numerous residences as a result of the night's assault. As typically, everyone still maintained normal activities – enduring hostilities. But those full day encapsulated Ukraine's critical military reliance on Western support – a reliance that European nations are clearly incapable to substitute in the short term.

Unsuccessful Negotiations

The 28-point plan from Washington sparked intense emotion, controversy and profound anxiety – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and bilateral conferences.

Every new approach from US leadership follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually win the battle. This trend will, no doubt, endure.

Strategic Calculations

It is tempting to accuse specific actors of persistently promoting Kremlin's demands. But that does not seem to be the entire situation. Washington works based on a principle understood by experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The American government assumes that it is impossible to compel Moscow to surrender the territory that it presently holds in Ukraine's south or east.

The issue is that while accepting these circumstances, Washington does nothing to discourage Russia, through statements or actions, from thinking that the situation will not shift further in its benefit in the months ahead.

Conflicting Perspectives

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their reason to agree to terms that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to stop fighting, but they will carry on as long as Russia's government remains highly assured in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, slowly losing civilians and areas but preventing a total frontline collapse until circumstances change in its benefit.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, subjective factors are coming into play: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the national cause against any proposal Kyiv finds unsuitable, so that their attention does not shift toward homefront challenges. And although their mission will now be considerably more difficult after latest incidents, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a mere seven days to kill the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the rest of Europe, along with soothing efforts of representatives, and finally, current information leaks, all achieved their purpose.

While new initiatives based on established approaches are imminent, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and reflect certain reluctance to modify developments, if they stand together and improve their protective measures at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, primarily depend on sustained allied backing.
